You must be at least 18 years of age to use our website, submit an application, or engage Thrivv for any services. By using our services, you represent and warrant that you meet this age requirement and that all information you provide to Thrivv is true, accurate, current, and complete. You agree to promptly update any information that changes.

Thrivv provides management, consulting, promotional, marketing, monetization, and creator growth services to qualifying creators. The specific services made available to any individual creator may vary based on the creator’s goals, niche, experience, audience, and the scope of work agreed upon between Thrivv and the creator. Thrivv reserves the right to refuse, modify, or discontinue any service at its sole discretion.

“Our service fees vary creator to creator based on the level of marketing required, desired income, event attendance, and the full scope of management services requested.”

All fees are determined individually for each creator and are documented in a separate written agreement. Fees may be changed by mutual written agreement between Thrivv and the creator. Unless otherwise stated in writing, all fees are non-refundable.

Results vary significantly from creator to creator. Thrivv does not guarantee any specific outcome, including but not limited to: income, earnings, followers, subscribers, brand deals, livestream revenue, social media growth, engagement, sponsorships, or business success.

Any examples, testimonials, or past performance referenced by Thrivv are for illustrative purposes only and are not indicative of future results. Your success depends on factors that include your effort, content quality, consistency, audience response, and market conditions outside of Thrivv’s control.

Thrivv’s services often involve third-party platforms that we do not own or control. Thrivv is not responsible for any of the following events that may occur on or in connection with these platforms:

• Account suspensions
• Account bans
• Demonetization
• Algorithm changes
• Platform policy changes
• Payment processor issues
• Technical outages
• Loss of followers, views, or engagement

These third-party platforms include, without limitation: Instagram, TikTok, YouTube, Snapchat, OnlyFans, Chaturbate, Stripchat, and X (Twitter). Your use of any third-party platform is governed solely by that platform’s own terms and policies.

As a creator working with Thrivv, you are responsible for:

• Following all platform rules and guidelines applicable to your content.
• Complying with all applicable federal, state, and local laws.
• Paying your own taxes, including any self-employment taxes, on income you earn as an independent contractor.
• Maintaining control of your own accounts unless otherwise agreed in writing with Thrivv.
• Ensuring that all content you produce, post, or submit is lawful and owned (or properly licensed) by you.

Creators retain ownership of the content they create. By submitting content to Thrivv, you grant Thrivv a non-exclusive, royalty-free, worldwide license to use that content for promotional, marketing, case study, portfolio, recruiting, advertising, and business development purposes, unless otherwise agreed in writing. This license continues for as long as reasonably necessary for those purposes.

All Thrivv trademarks, logos, branding, website design, and proprietary materials remain the exclusive property of Thrivv.

Your privacy is important to us. All personal information collected through our website or services is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

To the maximum extent permitted by law, Thrivv, its owners, officers, employees, contractors, and affiliates shall not be liable for any lost profits, lost income, lost business opportunities, indirect, incidental, special, punitive, or consequential damages arising out of or relating to your use of our website or services, even if Thrivv has been advised of the possibility of such damages.

Thrivv’s total aggregate liability for any claim arising out of these Terms shall not exceed the total fees paid by you to Thrivv in the three (3) months preceding the event giving rise to the claim.

You agree to defend, indemnify, and hold harmless Thrivv and its owners, officers, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your actions, content, conduct, or any violation of law or these Terms.

Thrivv may suspend or terminate your access to our website or services at any time, at its sole discretion, with or without notice. You may discontinue services at any time, subject to the terms of any written agreement between you and Thrivv. Sections that by their nature should survive termination (including IP, liability, indemnification, and governing law) will survive.

These Terms are governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Arizona, and you consent to the personal jurisdiction of those courts.

Thrivv may update these Terms of Service at any time. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use of our website or services after any update constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using our website and services.
